This page (together with the documents referred to) tells you the terms of use on which you may make use of our site. It supplements and should be read in addition to other terms and conditions that you have agreed to in connection with your use of our website or our services. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, Do not use our site.

1. Information about us

The sites "tuxtel.net" and "tuxtel.co.uk" and "tuxtel.uk" are operated by Tuxtel Ltd (Company No.06774113) a limited liability company whose registered address is: Admiral's Yard, Eckington, Sheffield S21 4HL.

2. Accessing our site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our site or our entire site.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

3. Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

4. Reliance on information posted

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

5. Our liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, Tuxtel Ltd, and any third parties connected to us expressly exclude:

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity
  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any web sites linked to it and any materials posted on it.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

6. Information about you and your visits to our site

We process information about you in accordance with our privacy policy.  By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

7. Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you.

Our site must not be framed on any other site. We reserve the right to withdraw linking permission without notice.

8. Links from our site

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

9. Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

10. Variations

We may revise these terms of use at any time by amending this page. You are expected to check this page each time you access the site to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

Addendum to General Terms & Conditions of use concerning domain names

1. Domain name related services

1.1 Domain name registration

Tuxtel charges a flat-fee of £50 +VAT per year, per domain name in the dot UK (.uk), dot com (.com), dot net (.net) and dot org (.org) name spaces. This includes initial registration (or transfer-in) of the domain name, hosting of unlimited e-mail accounts, and 10MB of hosted web space. Separate charges will apply for database hosting, specific software libraries (PHP, Perl, etc.) and additional hosting space.

1.2 Domain name renewal

In order to renew a domain name and the service(s) associated with it, customers need to ensure that payment for the periodic invoice(s) relating to the supply of such service(s) is received within 30 days of receipt. As invoices and reminders are sent by e-mail only, the customer is responsible for ensuring that Tuxtel is always kept informed of an up-to-date e-mail address that the customer checks regularly.

1.3 Domain name release

Tuxtel does not charge to release a domain name to other registrars; however, any outstanding invoices must be settled with Tuxtel before a request for domain transfer may be considered. Expiry dates are preserved when moving between registrars, and so any prepaid registration amounts will not be refunded in the event that a domain is transferred mid-term. Whether or not the new registrar chooses to charge further fees when taking-on your domain is up to them, and this is something that you should carefully check in advance with the new incumbent before initiating a transfer.

The customer should be aware that once a domain name has been cancelled, transferred away from us or has been allowed to lapse, Tuxtel usually deletes the files relating to any web-site(s) associated with inactive domain(s) in order to preserve storage space. Therefore, customers should ensure at all times that they have a fully up-to-date copy of all files relating to the operation of their domain name and associated web site, including all e-mails, text and picture files, scripts, databases, database records and any other resources that would be needed to build or reinstate the complete web site afresh. Tuxtel is not responsible for the upkeep, maintenance, retention or archiving of source web files, and will therefore not be liable for any damages or loss of business - direct, indirect, consequential or otherwise - that may arise from missing data once a domain name has lapsed.

1.4 Domain name complaints

In the event of a complaint, or complaints relating to how Tuxtel provides or administers domain names, you should in the first instance send your concerns to us in writing using the 'contact us' feedback form on the main Tuxtel web page.

If you are unable to use the reply form, you may send a regular e-mail to: 'nominet' followed by the '@' sign, and then tuxtel dot net. Be sure to include full details of your concern(s), as well as your preference for how (e-mail, telephone, letter etc.) and when (your preferred contact time) we should reply to you.

In both cases, messages sent via the feedback form or direct e-mail are copied to the inboxes of several members of staff, and will be acknowledged by one of them within four working hours of receipt. In all cases, the team member opening your e-mail will be your point of contact for all future communications relating to the issue, unless we tell you otherwise.

Should you not be satisfied with the response you receive from the staff member initially designated to deal with your enquiry, you may ask for your case to be escalated to another member of staff within the company.

2. Domain names in the dot uk (.uk) space

Tuxtel is a tag-holding channel partner and registrar with Nominet UK, the provider of domain names in the '.uk' domain name space. Nominet's general terms and conditions relating to the provision of dot UK domain names can be found here.

2.1 Domain name registration, renewal, expiry & cancellation

Tuxtel registers dot uk (.uk) domain names on behalf of customers directly with Nominet UK, and not via any third party reseller(s).

With specific respect to dot uk (.uk) domain names: two months prior to the domain registration expiry date, customers will be sent a renewal invoice by e-mail. Should the invoice remain unpaid after a period of 30 days, services relating to the domain (hosting, e-mail, web etc.) will be suspended until payment is received. This means that our servers will reject e-mail and web requests sent to the domain. Should payment not be received within the next 30 days, your contract with us will be terminated and Tuxtel will allow the domain to lapse; at which point it will be subject to Nominet's own expiry policy. Approximately 92 days after the registration expiry date, the domain will be cancelled by Nominet and released back to the pool of available domain names, for registration by anyone.

Should the customer decide to pay after the registration expiry date (ie. about 60 days from receipt of invoice), but before the domain name has been cancelled by Nominet, then Tuxtel at its own discretion may offer to restore service, but only when cleared funds have been received in settlement of the original invoice, plus a late payment/administration fee of £25 +VAT. In any case the invoice (plus late fee) must be settled should the customer wish to transfer the domain name to an alternative registrar at this stage.

3. Abuse

We advise all customers to establish an 'abuse' alias as part of their domain implementation routine. Usually, this takes the form of an e-mail alias similar, but not necessarily identical to, 'abuse@yourdomainname'. You should encourage anybody receiving unwarranted, unsolicited or abusive content appearing to originate from your domain name to lodge their concerns with you via this e-mail address.

Abuse seeming to originate from any of Tuxtel's domain names can be reported by e-mail to 'abuse' at 'the tuxtel domain name concerned'.
